Commercial Landscape Agreement

SERVICES TO BE PROVIDED BY   
Native Outdoor Care (Herein referred to as “Contractor”)   
   
MOWING / TRIMMING / EDGING / BLOWING
   
  -All turf areas will be mowed and clippings removed or mulched.  Grass will be cut at a height of approximately 3-5 inches throughout the year but left slightly longer during the summer months for the turf to remain healthy during the stressful months.    
-Trimming of lawn areas not accessible by mowers will be trimmed with line trimmers at each service visit or as needed unless otherwise noted.    
- A bladed edger will be used on all established edges including sidewalks, patios, and drives.    
-All lawn clippings and debris will be blown from sidewalks, patios, and drives after each services visit.    

 TURF FERTILIZATION    
All turf areas will be fertilized seasonally.  You will be notified via lawn flags or door hangers when turf areas are fertilized. Recommendations will be given at that time.

   
 BED MAINTENANCE    
  Beds will be kept free of weeds, debris, leaves, etc. Beds will be raked when needed to maintain a clean appearance. Including mulch and rock.   


 PLANT / SHRUB CARE & FERTILIZATION    
-Plants will be pruned and trimmed throughout the year depending on the plant or shrub and the time of the year.  Dead matter will be removed immediately upon discovery. Any plants or annuals that need to be cut to the ground will be done at the appropriate time.    
- Plants and shrubs will be fertilized with both granule and topical application throughout the year as needed.    
-Any plants that are dead or dying will be brought to the client’s attention immediately.   
Plants will be replaced at customer’s request and will be billed separately unless contractor caused damage.    
 

IRRIGATION    
-If an irrigation system is present, the system started at the beginning of season and blown out at the end of the season. It will be monitored throughout the year for proper operation.  
If any components are deemed to be faulty, the conditions will be brought to your attention.  

OVERALL CLEANLINESS   
- Contractor will remove stray trash/debris on the property when needed   

ADDITIONAL NOTES ABOUT YOUR SERVICE  
Items which we are unable to include in our service:
1.    Responsibility for any damage caused by factors beyond our control. (Vandalism flooding, earthquakes, fire, disease, insect infestation.)  
2.    Pruning of trees over 15 feet high.  
3.    Watering of turf and bed areas if no irrigation system is present.  

4. Removal of pet waste

CONTRACT TERMS    
This agreement shall take effect upon the agreed date specified below. The client is also committed to the specified duration agreed upon below. 
Either the Client or Native Outdoor Care may cancel the contract with a  
30-day written notice. This contract will automatically renew every year unless the Client notifies Native Outdoor Care of cancellation with a 30-day written notice.   

Growing Months are considered April-November
   
 PAYMENT FOR SERVICES    
As consideration for services outlined in this contract, Client agrees to pay Native Outdoor Care the price outlined in this contract. Invoices for the current month’s services will be sent to the client on the 1st of each month. Any payments that are not received by the end of each month will be charged a 10% per month late charge beginning from the due date and continuing until paid in full.  Any amount which becomes 60 days past due will force collections and the client will be responsible for any legal fees incurred or any other costs incurred to collect the debt.    
If at any time during the contract a payment becomes more than 30 days past due, Native Outdoor Care may terminate contract for services 7 days after written notice is delivered to client.

 

 We are more than happy to provide you with services that may not be included in your contract.    
Any additional services requested would be an added cost to your normal monthly charges.   

CONFIDENTIALITY  
Native Outdoor Care and its employees, agents, or representatives will not at any time or in any manner, either directly or indirectly, use for the benefit of Native Outdoor Care or divulge, disclose, or communicate in any manner any information that is proprietary to the Client. Native Outdoor Care and its employees, agents and representatives will  
protect such information and treat it as strictly confidential. This provision will continue to be effective after the termination of this contract. Any oral or written waiver by Client of these confidentiality obligations, which allows Native Outdoor Care to disclose Client confidential information to a third party, will be limited to a single occurrence tied to the specific information disclosed to the specific third party, and the confidentiality clause will continue to be in effect in all other occurrences.  
Upon termination of this contract, Native Outdoor Care will return to Client all records, notes, documentation, and other items that were used created or controlled by Native Outdoor Care during the time of this contract.  

INSURANCE & LIABILITIES    
Native Outdoor Care agrees to maintain proper licenses and insurance as required by the State of Colorado.    
Client will not be held responsible for any personal injury or damage caused by direct actions of Native Outdoor Care and its employees; however, client is fully responsible for any damage or injury caused directly or indirectly through their own actions and the actions of their employees, agents, property owners or guests.

GUARANTEE  
Native Outdoor Care agrees to perform all landscaping and property maintenance services in a workmanlike manner and will not perform services or act in any way which is illegal or violates any state guidelines or city or county ordinances.    
    
By signing below, client agrees to and understands all terms and conditions outlined in this contract and “Services to Be Provided” section.

Cancellation Policy: As a courtesy, please contact us within 24 hours of your appointment (Seven days for projects requiring more than one day of work) to cancel or reschedule your appointment. Lack of preparedness, missed appointments and failure to give proper notice will result in 50% charge. We value your time, please value ours
